New York Foreclosure Victims To Be Helped By Court

House owners facing foreclosures will be helped by courts to try to save the houses that are their homes. The foreclosure process will be made easier, according to a new programme, said the Chief Judge of the New York state.
A new section in the court will be set aside to help borrowers reach a speedy settlement with the lenders. Notification would be sent out to the borrowers as soon as impending foreclosure is imminent. Legal and foreclosure counselors would help them and they would be requested to attend court settlement conferences. The programme would be partly voluntary. While settlement would be encouraged it would not be enforced or made mandatory for lenders, who would still remain free to foreclose.
Judith S. Kaye, the chief judge hoped that by getting the courts to be involved the judicial fraternity would be doing something more than just finally inking eviction orders. She said in a news conference in Lower Manhattan, that residents of New York were losing their houses in record numbers with some localities being worse off than others. She appealed, ‘Can we be part of an influence for the good? Senator Charles E. Schumer applauded the efforts of Judge Kaye’s plan saying this was “just what the doctor ordered.” He added that over half of those facing foreclosure could save their houses if they get the right type of counseling. Few cannot really afford to stay in the houses. But many others can, if they juggle around correctly with their finances. Here is where the services of a counselor come into play.
The pioneer project is ready to kick off in Queens this summer season. As per court records, foreclosures posting in the state have jumped by 150% since January 2005. In Queens the increase is by 223%. By the end of the year it is apprehended that the increase will be by as much as 40%.
Congress is mulling over the proposal of refinancing mortgages with federal backed insured loans. For this the new legislation will grant an extra $300 billion for mortgages. Only those whose primary residences are under threat of foreclosure will be entitled t apply. The lenders would have to of their own accord reduce the principal loan balance to make the loan more realistic and affordable. It is hoped that the bill (approved by the House) will get the green signal from the Senate and Bush.
