Florida Court Adopts New Method to Blast Through Foreclosure Cases

A Florida court has adopted a new method to blast through huge pile of foreclosure cases. All it requires are two questions in 15 seconds to finish a case that rules eviction in 45 days.

Saundra Hill Scott arrived at the county court house clutching her papers in a desperate attempt to save her home. But it was all in vain. The session was over in 20 seconds with the judge asking her only two questions – whether she was current on her mortgage and if she was living in the house. She answered in the negative and affirmative respectively while getting her papers ready. But the judge said that he had no need to see them as these were between the bank and her. The judge gave Scott 60 days to work out matters with the bank or clear out with her husband and three grandchildren.

The Obama government is ready with new measures to rescue the foreclosure victims but at this very point Lee County has come up with a new way to handle the mess. There is a jumbo backlog of work and the judges have taken the path of ‘rocket dockets’ to clear 1,000 cases per day. Help is being taken of retired colleagues to ease the work pressure.

The foreclosure crisis has been battering Florida like the worst type of hurricane. The state leads the nation in number of defaults and its legal system has been devastated with the huge number of foreclosure cases. This has led to cases piling up – ready to touch the sky. Although Obama is trying his best to keep the occupants in their houses, the officials of Lee County say that the numbers are so staggering that many are sure to lose their homes in any case.

Lee County’s clerk Charlie Green says that the court is still running through the February cases. These will exceed the January figures. Green quipped, “All these plans that the government has come up with are great. But it doesn’t help us get these cases off our books.”

Lee County has one of the worst hit regions of Florida. The residents are mainly working class. During the housing boom flippers moved in buying up properties for quick profits by selling them to the retirees and the working folks. In nearby Cape Coral, Millionaire University started to teach the speculators coming from all over USA how to make jumbo profits from buying and selling of houses. House prices doubled from 2000 to 2005. And then the bubble burst!
